Privacy Policy

AMERIKEEN LLC (“AMERIKEEN,” “we,” “us,” or “our”), an Arizona limited liability company, operates the website located at amerikeen.com (the “Website”) and provides AI consulting and AI operating-system (“AIOS”) deployment services. This Privacy Policy describes how we collect, use, share, store, and protect your personal information when you visit the Website, interact with our demo or AI assistant, or engage our services. By using the Website you agree to the practices described here.
1. Information We Collect
We collect information you provide directly and information generated automatically when you use the Website.
- Personal identifiers you submit through forms — name, email address, phone number, company name, company website, role, and the details you share about your business.
- Voice and interaction data — if you activate our interactive voice or chat assistant, we (and our AI providers) process the audio, text, and Command Center context you generate during that session in order to respond.
- Device and usage data — IP address, browser type, device identifiers, operating system, pages viewed, referring pages, and interactions with content or advertisements.
- Communications — records of messages, calls, and SMS exchanged with us, including consent records.
- Other information — any data you voluntarily submit, such as in a consultation or message.
1A. Voice Data; Not Used for Biometric Identification
The MYLEA voice assistant processes audio solely to generate responses. AMERIKEEN does not extract voiceprints, faceprints, or other biometric identifiers as defined by the Illinois Biometric Information Privacy Act (740 ILCS 14), the Texas Capture or Use of Biometric Identifier Act, or the Washington Biometric Identifier Act. We do not use voice data to identify or authenticate individuals, and we do not sell, lease, or disclose biometric identifiers.
2. How We Use Your Information
- To provide, maintain, and improve our Website, demo, AI assistant, and services.
- To respond to inquiries, schedule and conduct consultations, and deliver requested services.
- To send transactional messages (e.g., appointment confirmations) and, with your consent, marketing communications via email, phone, or SMS.
- To personalize your experience and analyze how the Website is used.
- To detect, prevent, and address fraud, abuse, security incidents, and technical issues.
- To comply with legal obligations and enforce our agreements.
2A. AI Processing & Your Inputs
Portions of the Website use AI systems (xAI Grok for the MYLEA voice assistant; Anthropic Claude for research features when enabled). You are interacting with an AI, not a human. Your inputs (voice, text, Command Center context) are transmitted to these providers to generate responses. AMERIKEEN does not permit these providers to use your inputs to train their public or third-party models. AI outputs may be inaccurate, incomplete, or out of date; you are responsible for verifying outputs before relying on them. The demo dashboard at amerikeen.com is a directional sketch, not the finished product.
3. Legal Bases for Processing (EEA/UK Visitors)
If you are in the European Economic Area or the United Kingdom, we process your personal data on the following legal bases: your consent (e.g., for marketing or SMS); the performance of a contract (to deliver services you request); our legitimate interests (to operate, secure, and improve our Website and services, balanced against your rights); and compliance with legal obligations. You may withdraw consent at any time without affecting prior processing.
AMERIKEEN does not currently maintain an establishment in the EEA or UK. If we determine our processing falls within GDPR Art. 3(2) or UK GDPR Art. 3(2), we will designate a representative under Art. 27 and publish their contact details in this section. Until then, EEA/UK data subjects may contact info@amerikeen.com directly.
4. How We Share Your Information
We do not sell your personal information. We share it only as described below:
- Service providers (subprocessors) who process data on our behalf under contract — see Section 5.
- Business partners, only where necessary to deliver a service you have requested.
- Legal and compliance — when required to respond to lawful requests, enforce our terms, or protect rights, safety, and property.
- Business transfers — in connection with a merger, acquisition, or sale of assets.
SMS carve-out: text-messaging originator opt-in data and consent are not shared with any third parties or affiliates for marketing or promotional purposes, and are excluded from all categories of sharing above.
5. Where Your Data Is Stored & Our Subprocessors
Our infrastructure and primary data storage are located in the United States. We rely on the following categories of third-party providers, who may process your information:
- Hosting & content delivery — Vercel, Inc. (United States).
- Security & bot protection — Cloudflare, Inc. (CAPTCHA/Turnstile, DNS, edge security).
- CRM & email — Zoho Corporation (contact records, business email, scheduling).
- AI processing — our interactive assistant routes your inputs to third-party AI providers (such as xAI) to generate responses; AMERIKEEN does not use these inputs to train public models.
- Analytics & communications — analytics and email-delivery providers that help us understand Website usage and send communications.
International transfers: if you access the Website from outside the United States, your information will be transferred to and processed in the United States. Where required, such transfers are made under appropriate safeguards (such as Standard Contractual Clauses).
6. Data Retention
We retain personal information for the periods below, after which it is deleted or irreversibly anonymized:
- Contact-form and CRM records — 7 years after last interaction (tax and contractual recordkeeping).
- Voice assistant transcripts and audio — 30 days, unless tied to an active engagement.
- Marketing-consent records — until consent is withdrawn, plus 3 years (proof of consent).
- Server logs and security events — 12 months.
- Cookies — per the durations disclosed in §8.
7. SMS & Mobile Communications
If you opt in to receive SMS messages, we use your phone number solely for the purposes you consented to. You can cancel at any time by replying STOP; reply HELP for assistance. Message frequency varies and message and data rates may apply. Carriers are not liable for delayed or undelivered messages. SMS consent is not a condition of purchase.
8. Cookies & Tracking Technologies
We use cookies and similar technologies to operate the Website, remember preferences, analyze traffic, and (where applicable) measure marketing. Our bot-protection provider may set a token to verify you are human. You can control cookies through your browser settings; you can opt out of Google Analytics via tools.google.com/dlpage/gaoptout.
Global Privacy Control. We treat a Global Privacy Control (GPC) browser signal as a valid opt-out of sale/sharing under CPRA. Because we do not sell or share personal information for cross-context behavioral advertising, GPC users are already covered.
9. Your Rights & Choices
All visitors: you may opt out of marketing communications at any time (reply STOP to SMS, use the unsubscribe link in emails). Transactional messages may continue.
EEA/UK (GDPR): you have the right to access, correct, delete, restrict, or object to processing of your personal data, and the right to data portability. You may also lodge a complaint with your local supervisory authority.
California (CCPA/CPRA): you have the right to know what personal information we collect and how it is used and shared; to delete it; to correct it; and to opt out of any sale or sharing for cross-context behavioral advertising. We do not sell or share your personal information in this sense.
Non-Discrimination. AMERIKEEN will not deny services, charge different prices, or provide a different level of quality because you exercised a CCPA right. Notice at Collection. In the prior 12 months we have collected the following categories of personal information: identifiers, commercial information, internet/network activity, audio (voice assistant), professional/employment information, and inferences. We do not sell or share personal information for cross-context behavioral advertising. We retain each category only as long as needed for the purpose disclosed in §2 and never longer than seven (7) years after the end of the business relationship.
Sensitive Personal Information. AMERIKEEN does not use Sensitive Personal Information (including audio collected by the voice assistant) for any purpose other than providing the service requested. You are not required to submit a “Limit Use of My Sensitive Personal Information” request because we already limit such use by default.
Response windows and verification. We will acknowledge a verifiable request within 10 business days and respond substantively within 45 days (CCPA/CPRA) or 30 days (GDPR/UK GDPR), extendable once by an additional 45 or 60 days respectively with notice. We verify identity by matching the request against information already on file or, where necessary, by requesting government-issued ID through a secure channel.
Authorized Agents. California residents may designate an authorized agent in writing to submit requests on their behalf. Appeals. If we deny a privacy request, you may appeal by emailing info@amerikeen.com with the subject “Privacy Appeal.” We will respond within 45 days.
To exercise any right, email info@amerikeen.com. We will verify your request and respond within the timeframes required by applicable law.
10. Data Security
We implement reasonable administrative, technical, and organizational measures — including encryption in transit, access controls, rate limiting, and bot protection — to safeguard your information. No system is completely secure, however, and we cannot guarantee absolute security.
Breach notification. If we become aware of a security incident affecting your personal information, we will notify you and applicable regulators without undue delay and in accordance with applicable law (typically within 72 hours of confirming a notifiable breach under GDPR Art. 33 and within statutory windows under US state breach-notification laws).
11. Children’s Privacy
Our Website and services are not intended for children under 18. If we learn we have collected information from a child under 18, we will delete it.
12. Third-Party Links
The Website may contain links to third-party sites. We are not responsible for their privacy practices and encourage you to review their policies.
13. Changes to This Policy
We may update this Privacy Policy from time to time. Changes are posted here with an updated effective date; continued use of the Website constitutes acceptance.
